Arraignment for Man Arrested for Naked Break-in, Attempted Murder

Judge Edward DeCaro Sets Preliminary Hearing Date for June 19

Phillip Kenneth Matovich, 26, the naked man arrested for attempted murder on May 17 was arraigned Thursday at the Santa Barbara Superior Court by Commissioner Edward DeCaro. Represented by Public Defender Mark Owens, Matovich entered pleas of not guilty to the nine felony counts with which he was charged. His preliminary hearing will be held on Thursday, June 19, at 8 a.m., under Judge George Eskin.

The felonies Matovich was charged with include two counts of first degree burglary, two counts of assault with a deadly weapon, two counts of criminal threats, and two counts of false imprisonments by violence. According to Santa Barbara Police, Matovich was arrested after breaking into a house on Ladero Street, removing his clothes, threatening to murder the house's inhabitants, and then running from police to another house for a repeat performance. Police say Matovich was tasered and apprehended while attempting to hold a woman hostage in the second house.

Also charged with three counts of probation violation, the probation office filed a no bail probation hold against Matovich, while his bail for the other nine counts was set at $500,000.

Skip to the bottom of the article here! It says he's on a NO BAIL probation warrant for violating his probation 3 times! 3 TIMES!!

Our judicial system grants this guy another fair trial? Inexcusable! The cops caught this guy red handed, naked with a knife around some woman's neck in HER house!! And just because this walking disease to humanity decides to plead not guilty, we give him, yet another fair trial.

I often commend the S.B Police Department on their restraint AND their use of quick, decisive, and accurate force when needed. I believe THAT very force would have been well received in this case. Just think, if instead of a taser to subdue this animal, that officer employed the same brilliant accuracy to put one round right into this guy's forehead. We wouldn't need a trial, justice would have been served, and furthermore MY TAX DOLLARS would be spared for something hopefully a bit more constructive.

Turn this criminal in to horse feed and let's move on!

You must remember that we are a nation of laws and not men. Even caught red handed this man deserves a fair and just trial, which, given the evidence already in the public domain, should be an easy one for the prosecution.

He most likely violated his probation three times based on the acts he's currently charged with and not because the legal system gave him three chances in the past.

But Ben Franklin also supported the use of arms against England. And that's where I'm at . . . down here in the lower West Side. I used to live in the very place this guy was tazered and now I'm one block away. Until you've had stabbings, beatings, and arson fires on your block you have no reason to quote the founding fathers. They embraced violence, gained their freedom, and THEN wrote the Constitution.

This naked man woke me up at 6:00 am, in my yard, calling out to himself (Phillip). Imagine the horror I felt, and worse yet, the horror that the victims felt. I agree in part with the above comment, that somehow the justice system let us down if he skipped out on probation three times. The victims will probably never get over their horror and fear - it's not fair to them.
