indyreader, he got the Ketamine in Mexico, according to his testimony. I believe that might've been referenced in the original story I wrote a few weeks back, though I can't recall at this point. I'm not sure what other "missing links" to the story you find, but one reason for that is probably a word count limit I was dealing with for the print issue. Feel free to ask away if you have more questions and I'll do my best to answer.
And, as an update, the jury has been out since Monday, though two days they didn't deliberate, and a lot of the time was spent listening to readbacks of testimony. The six men and six women will be back in court tomorrow morning.
Cheers,
Chris

All traffic lanes on Highway 101 are now open, according to CHP. The reason the pick-up was traveling the wrong direction is still under investigation.

Hello everyone,
Here is some info that probably should've been included in the original story, but got lost in the shuffle between the info I had, and the info Nico, our court intern had. I think it will help with some of this discussion:
There was no plea bargain or settlement, but these two pleaded to the charges that were filed against them.
Dudley argued for the maximum time in state prison---in this case three years six months---for Yglesias and that he register as a sex offender. The victim asked the judge for 16 months in state prison. As it states in the story, Ochoa sentenced him to 270 days.
Dudley asked that Jacobo be sentenced to the maximum time in state prison for the crime he was charged with and he pleaded to as well: 180 days. The victim asked the judge for 75 days, a length of time Ochoa agreed to.
I hope that helps.

SBRocks, you are correct about Dudley. She has been with the office since 1990, not 1980. Not sure if it was a slip of the finger or if I confused the figure with that of Stanley, who has been here since 1980. Regardless, I apologize for the mishap.

According to Mailes, who I couldn't get a hold of prior to leaving for the day, the driver was 24 years old. "He had already failed his driving test when he returned to the DMV," Mailes wrote in an email. "The examiner instructed him to place the vehicle in park. Instead of putting on the brake, he floored it into the building."

We probably won't have too any updates unless the jury comes back with questions, or there is a verdict. As of this time, no word from the jury since Monday.

FYI we're posting a story about jury questions today. Check back in later. They're still deliberating.

To explain quickly (it will be explained more thoroughly in jury instructions tomorrow as well as in a story I'm working on for this week): he is being charged with both aggravated kidnapping as well as murder with special circumstances. The special circumstance is what could lead to him getting the death penalty if found guilty. He could still get life in prison (like Rugge), if convicted on aggravated kidnapping.

Correction:
Richard Berti did not pay $1.5 million in punitive damages to the Gottesman family. The payment was in fact a compromise settlement, and as such, the Gottesmans have dismissed all claims and awards for punitive damages, and can no longer pursue punitive damages against Berti.
As part of the settlement compromise, there is no admission of liability or responsibility by Berti.
