"...free for use with the appropriate passes" is an oxymoron because the passes are not free. A fee can be charged, or a pass required, for the use of a developed facility, but not just to park at a trailhead and take a hike. It doesn't matter what amenities are installed at the trailhead, it is only for using them that a fee can be required. That was the core of the 9th Circuit ruling.
