The Massachusetts Nurses Association, the union representing 3,200 nurses at the Brigham, said in its lawsuit that the hospital’s mandate, which could lead to the firing of employees who refuse vaccination, violates a state regulation that explicitly bars hospitals from requiring employees to the receive vaccine if they don’t want it, regardless of the reason.

McDonough said Brigham officials “believe that we have interpreted the statute correctly, but will await clarification before implementing a mandatory policy.”

David Schildmeier, the spokesman for the nurses’ union, called the regulation “crystal clear.”

“Every employee has a right to decline,” he said. “All they have to do is sign a form. They don’t have to give a reason.”

More Than $1B in Payments to Doctors is Excluded From Sunshine Database

Last week, the federal government unveiled the long-awaited Open Payments database, which was created to disclose the payments that drug and device makers make to physicians and teaching hospitals.

The effort, which reflected concerns over industry ties that may unduly influence medical practice and research, was not without problems. There were technical glitches and complaints that payment data would lack sufficient context for patients to understand what they see.

Now, though, another issue has arisen. In discussing the database last week, officials at the Centers for Medicare & Medicaid Services noted the data reflected 4.4 million transactions valued at $3.5 billion to 546,000 doctors and 1,360 teaching hospitals.

But more than $1.1 billion in transactions were actually not included, according to a CMS fact sheet released yesterday and first reported by ProPublica. That represents nearly 24% of the total value of transactions reported to the agency so far. A CMS spokesman tells us the omission was noted in a conference call with media last week, but the agency did not have specific figures at the time.

“Most [of the missing payments] are related to research funding that was not available to us,” the CMS spokesman writes us. “Other [payments] were in disputed ownership and investments,” a separate database detailing physician financial holdings. “More updates to come in [the] next round.”

In the latest study to explore financial relationships between researchers and the pharmaceutical industry, a new analysis finds that researchers with ties to drug makers that sell flu treatments more often reported positive findings in their studies of those medicines.

The analysis found seven of eight studies, or 88%, that analyzed previous research of such medicines as Tamiflu and Relenza – and were conducted by individuals with ties to drug makers – were considered favorable. By contrast, five of 29 reviews, or 17%, by those without such ties were considered favorable (here is the abstract).

“This is a huge discrepancy,” Florence Bourgeois, one of the co-authors and an assistant professor of pediatrics at Boston Children’s Hospital, tells Bloomberg News. “While we can’t comment specifically about what the effect the conflicts of interest are, it raises concerns and questions around how this came about.”

The study, which appears in The Annals of Internal Medicine, was undertaken, in part, because neuraminidase inhibitors – as the flu treatments are known – have been the subject of ongoing uncertainty about specific clinical benefits, the authors explained.

This was true for Tamiflu, for instance, which is sold by Roche. Last April, a study found the effectiveness of the treatment was not proven to reduce the spread of flu or flu complications, which raised questions about its usefulness against pandemics. More recently, the drug maker disputed the findings.

Complaint filed against CDC cover-up of MMR causing autism

In a complaint filed today with the US Office of Research Integrity top scientists and administrators at the Centers for Disease Control and Prevention (CDC), including former CDC chief Julie Gerberding, are accused of covering up the discovery of significantly higher autism rates among children, including a 250% increase in African American males, who received the Measles Mumps Rubella vaccine (MMR). The complaint is based on thousands of documents released to Rep. Bill Posey among others by William Thompson, Ph. D., a senior CDC scientist who was a co-author of a 2004 CDC study that Thompson now claims was deliberately altered to hide a clear association between MMR and autism. The Office of Research Integrity investigates allegations of research misconduct and fraud in agencies under the Department of Health and Human Services, which also includes the CDC.

Thompson also provided internal CDC information to Dr. Brian Hooker, a biochemist at Simpson University, who recalculated the data according to the original study rules and found the same much higher autism rates in African American males and other groups who received the MMR younger than 3 years compared to those received the MMR older than 3 years. Once these elevated autism rates were found by the CDC researchers, the study was altered to hide the association according to Thompson and the complaint.

Dr. Hooker, a PhD scientist, worked with two members of Congress to craft the letter to the CDC that recently resulted in his obtaining long-awaited data from the CDC, the significance of which is historic. According to Hooker, the data on over 400,000 infants born between 1991 and 1997, which was analyzed by CDC epidemiologist Thomas Verstraeten, MD, “proves unequivocally that in 2000, CDC officials were informed internally of the very high risk of autism, non-organic sleep disorder and speech disorder associated with Thimerosal exposure.”

In July 1999, public-health officials announced that thimerosal would be phased out of vaccines. The CDC, American Academy of Pediatrics, and FDA insisted that the measure was purely precautionary. They requested of all vaccine manufacturers to eliminate mercury from vaccines.

The requests were denied by vaccine manufacturers and continued every year thereafter.

The FDA does not require ingredients that comprise less than 1 percent of a product to be divulged on the label, so a lot more products may have thimerosal and consumers will never know.

“Gardasil and Cervarix Don’t Work, Are Dangerous, and Weren’t Tested”

Dr. Diane Harper was the lead researcher in the development of the human papilloma virus vaccines, Gardasil and Cervarix. She is the latest to come forward and question the safety and effectiveness of these vaccines.

She made the surprising announcement at the 4th International Public Conference on Vaccination, which took place in Reston, Virginia on Oct. 2nd through 4th, 2009.

Her speech was supposed to promote the Gardasil and Cervarix vaccines, but she instead turned on her corporate bosses in a very public way. When questioned about the presentation, audience members remarked that they came away feeling that the vaccines should not be used.
At the time of writing, 44 girls are officially known to have died from these vaccines. The reported side effects include Guillian Barré Syndrome (paralysis lasting for years, or permanently — sometimes eventually causing suffocation), lupus, seizures, blood clots, and brain inflammation. Parents are usually not made aware of these risks.

Dr. Harper, the vaccine developer, claimed that she was speaking out, so that she might finally be able to sleep at night.

“About eight in every ten women who have been sexually active will have H.P.V. at some stage of their life. Normally there are no symptoms, and in 98 per cent of cases it clears itself. But in those cases where it doesn’t, and isn’t treated, it can lead to pre-cancerous cells which may develop into cervical cancer.” – Dr. Diane Harper
