Judge Denies Prosecutiorial Misconduct Charges In McDermut Hit-and-Run

The California Court of Appeal rejected arguments that Santa Barbara prosecutor Josh Lynn engaged in prosecutorial misconduct during the vehicular homicide trial of Montecito real estate agent Maureen McDermut, who accidentally killed pedestrian Joseph Cohn in August 2003. A controversial simulated photo had been introduced by the prosecution to show that McDermut had to have known that she hit someone. McDermut served five months of a one-year sentence.
