No Double Jeopardy in Lyons Case

Judge Brian Hill on 1/3 denied Corey Lyons’s motion to dismiss his double murder case on the grounds of double jeopardy. Bob Sanger, attorney for Lyons, claimed the prosecution provoked the defense to file for a mistrial by asking a question of a witness that led to inappropriate hearsay statements. While Hill admitted the question was perhaps a little thoughtless, he stated that it was not reckless and thus double jeopardy didn’t apply. Lyons will head back to trial in a couple weeks, where Hill is hoping to streamline the jury selection process to get the new trial underway quickly.
