Woman Was Not in Crosswalk; Driver Had Been Drinking but Wasn't Impaired

A 53-year-old woman was hit and killed Sunday night as she crossed Cabrillo Boulevard. According to police, the victim, Silvia Diaz of Gustine, California, had attended a wedding reception at the nearby Casa Las Palmas building and was returning to her car parked on the south side of Cabrillo. She was not in a crosswalk when the accident occurred. Diaz was transported to Santa Barbara Cottage Hospital where she was pronounced dead shortly after arrival.

The driver, 22-years-old, had been drinking prior to the accident, but police determined he was not sufficiently under the influence to impair his driving. He voluntarily provided a breath sample at the scene which registered a 0.03 blood alcohol level. The legal limit is 0.08.

As officers responded to the scene and began their investigation, an unrelated, unlicensed DUI driver crashed through the police barricades and was arrested.
