Your article on the Miramar tax issues was erroneous in one important respect.

Assessment Appeals Hearing Board member Jana Zimmer, who retired from active legal practice in 2010 to devote herself to art and public service, is, sadly, no longer representing El Capitan Canyon. Our professional relationship ended, amicably, when we obtained land use approvals from the County Zoning Administrator in December of 2010 for relocation of campsites and new supporting facilities.

El Capitan Canyon has no interest in the outcome of the particular property tax reassessment case which was the subject of your story.

As for the entirely separate issue of the proposed countywide transient occupancy tax rebate ordinance, although El Capitan Canyon does pay substantial transient occupancy tax, we do not yet have a position, because the terms of the program have not been made public, and we cannot evaluate how it might affect our property. We are seeking additional clarification and details from the county auditor. – Roger Himovitz, El Capitan Canyon Resort and Campground owner

Editor’s Note: Our apologies. As the letter points out, Zimmer represented the campground in the past, but has since resigned.
