No Retrial for Botello
The district attorney’s office announced in a hearing on 5/10 that it would not retry its case against Ernesto Botello in the death of 12-year-old Jake Boysel. A mistrial was declared 5/1 by Judge Clifford Anderson. In a misdemeanor case, when the jury comes back undecided, the DA’s office has 30 days to retry the case. The decision means Botello can never face the same charges again.
