Santa Barbara Superior Court Judge Thomas Anderle threw out a lawsuit by the city against Heather Poet, the sponsor of a recently passed ballot initiative to make marijuana offenses by adults the lowest law enforcement priority in the city. “Apparently finding suit against all of its electors untenable,” the city had to sue someone to determine the constitutionality of the initiative, Anderle wrote. The ACLU attorney who represented Poet called the decision a “resounding affirmation of voters’ right to de-prioritize marijuana enforcement.”
